To raise modifying the CC&Rs to implement long term rental restrictions at our annual HOA meeting would be challenging to garner enough participation to make the change
But RCW 64.90.285 prohibits adopting any amendments that alter the interests of the unit owners without the signature/consent of the affected unit owners. That was adopted as part of Washington’s sweeping changes adopted to community interest laws in 2023 and effectively negates any ability for a majority in a development to reduce the interest of an owner as compared to what they signed up for when they purchased the property.
Thus, we could add this to an agenda, actually achieve a quorum and have 90% of the neighborhood owners adopt it as a new covenant amendment, then the other owners who didn’t vote in favor still couldn’t be compelled to abide by the newly adopted restriction. Adopting such an amendment may act as a deterrent for people purchasing later in the neighborhood and would restrict all the properties of the owners who agree to the restriction in the future but it wouldn’t actually restrict any property of an owner who didn’t consent and vote in favor of the amendment.
